Overall Educational Objective The overall objective of the course is to comprehensively examine the basic principles of the right to a fair trial and how this right is shaped in the context of international law, especially the judgements of the European Court of Human Rights (ECtHR). The course will examine how relevant international conventions, in particular the European Convention on Human Rights, and domestic law protect and promote this right. The course provides students with the opportunity to develop critical thinking skills on the protection and promotion of the right to a fair trial and guides them in understanding legal practice. The course also aims to develop students' legal analysis skills by examining the universal standards of the right to a fair trial and the prominent judgements of the European Court of Human Rights on this right. In this way, they will understand how the right to a fair trial is applied in international law and the role of the ECtHR in protecting this right. In this framework, the course aims to deepen students' capacity for legal thinking by enabling them to understand how the right to a fair trial is protected and to evaluate the practical problems encountered in the implementation of this right.
Course Description The right to a fair trial is one of the cornerstones of legal systems and guarantees individuals the right to a fair and impartial judicial process. It encompasses fundamental rights such as the right of everyone to be tried by a competent, independent, and impartial tribunal established by law, the right to a public hearing within a reasonable time, the presumption of innocence, the right to prepare a defence and the right to question witnesses. The right to a fair trial stands for equality, transparency and justice before the law and constitutes one of the fundamental building blocks of democratic societies. Building on the importance of upholding the rule of law, this course examines how ECtHR judgments have protected and promoted this right. Students will gain an in-depth understanding of the theoretical foundations and practical applications of the right to a fair trial by analysing the ECtHR's judgments on individual applications concerning these rights. This course provides students with the opportunity to develop critical thinking skills on the protection and promotion of the right to a fair trial and guides them in understanding legal practice. The course begins by examining key international instruments, in particular the European Convention on Human Rights, to understand what the right to a fair trial means. The basic elements of the right to a fair trial and other rights under this right will be presented to students in detail; in particular, the right to a judicial remedy, the right to an independent and impartial tribunal, the right to a fair trial, the right to a fair trial, the right to a trial within a reasonable time, the right to a public trial, the presumption of innocence, the rights of the accused, the right to a fair trial in special circumstances will be evaluated in the light of case law.
Course Description in Turkish Adil yargılanma hakkı, hukuk sistemlerinin temel taşlarından biridir ve bireylerin adil ve tarafsız bir yargı sürecine sahip olmalarını garanti altına alır. Bu hak, herkesin yasalarla kurulmuş yetkin, bağımsız ve tarafsız bir mahkeme tarafından yargılanma hakkını, makul sürede kamuya açık bir duruşma hakkını, masumiyet karinesi, savunma hazırlamak ve tanıkları sorgulama hakkı gibi temel hakları kapsar. Adil yargılanma hakkı, yasalar önünde eşitlik, şeffaflık ve adaleti temsil eder ve demokratik toplumların temel yapıtaşlarından birini oluşturur. Hukukun üstünlüğünün korunmasının önemini temel alan bu ders, AİHM kararları çerçevesinde ilgili bu hakkın nasıl koruduğunu ve desteklediğini inceler. Öğrenciler, AİHM'in bu haklarla ilgili verdiği bireysel başvuru kararlarını analiz ederek, adil yargılanma hakkının teorik temellerini ve pratikteki uygulamalarını derinlemesine anlayacaklardır. Bu ders, öğrencilere, adil yargılanma hakkının korunması ve geliştirilmesi konusunda kritik düşünme becerilerini geliştirme fırsatı sunar ve hukuki uygulamaları anlamalarında onlara rehberlik eder. Ders, adil yargılanma hakkının ne anlama geldiğini anlamak için temel uluslararası belgeleri, özellikle de Avrupa İnsan Hakları Sözleşmesi'ni inceleyerek başlar. Adil yargılanma hakkının temel unsurları ve bu hak altındaki diğer haklar, öğrencilere detaylı bir şekilde sunulacak; özellikle, bir yargı yerine başvurma hakkı, bağımsız ve tarafsız bir mahkemeye başvurma hakkı, hakkaniyete uygun yargılanma hakkı, makul sürede yargılanma hakkı, aleni yargılanma hakkı, masumiyet karinesi, sanığa tanınan haklar, özel durumlarda adil yargılanma hakkı konuları örnek içtihatlar ışığında değerlendirilecektir.

2) Identifies the basic principles and international standards of the right to a fair trial.
3) Analyses the prominent decisions of the European Court of Human Rights on the right to a fair trial.
4) Knows the basic concepts, international standards and court decisions on the right to a fair trial.
5) Evaluates the social effects of the right to a fair trial and understands the responsibility for this right as an individual.
6) Demonstrates how relevant international conventions, especially the European Convention on Human Rights, and domestic legal regulations protect and promote this right.
