Course Description | This course aims to overview the general principles and elements of non-contractual liability law and analyze and evaluate the current decisions of Turkish Court of Cassation and Swiss Federal Supreme Court. Within this respect, some of the issues that will especially be of importance are general principles for liability, different grounds for liability (such as liability with fault or without fault) and determination of the scope of liability, limitation and extension of the scope of liability, limitation periods and whether these can be modified, liability of more than one person from the same damage. | ||||
Course Description in Turkish | Bu derste sözleşme dışı sorumluluk hukukunun temel unsurları ele alınacak ve ilgili konular bağlamındaki güncel Yargıtay ve İsviçre Federal Mahkemesi kararları üzerinden problem bazlı değerlendirmeler ve analizler yapılacaktır. Sözü edilen çerçeve dahilinde, temel sorumluluk ilkeleri, farklı sorumluluk sebepleri (kusura dayalı ve kusursuz sorumluluk) ve sorumluluk kapsamının belirlenmesi, sınırlandırılması, sorumluluk zamanaşımı ve birden fazla kişinin aynı zarardan sorumluluğu gibi hususlar üzerinde özel olarak durulacaktır. |
