Overall Educational Objective To learn about the technical and legal aspects of blockchain and smart contracts, and how to evaluate them within the framework of the current legal system
Course Description Smart contracts are digital structures that ensure the performance of certain obligations automatically. Such structures may consist of various content. The distinctive nature of blockchain technology has contributed greatly to the development and security of smart contracts. This course aims to discuss the operation of such digital structures and analyze if the current legislation applies to such structures and how they may be applied, specifically in relation to validity, termination, performance and non-performance of smart contracts, as well as compliance with data protection regulations. Problems that may arise in relation to the above issues will be analyzed in depth within the course.
Course Description in Turkish Akıllı sözleşmeler, belirli taahhüt sonuçlarının otomatik olarak sağlanmasını temin eden dijital yapılardır. İlgili yapılar, farklı içerikleri haiz olabilirler. Blokzincir teknolojisinin kendisine has özellikleri, akıllı sözleşmelerin gelişimine ve güvenilirliğine önemli bir katkı sağlamıştır. Bu ders kapsamında anılan dijital yapıların (blokzincir ve akıllı sözleşmeler) işleyişi, yine sözü geçen yapılara var olan hukuk kurallarının nasıl tatbik edileceği, özellikle akıllı sözleşmelerin geçerliliği, sona ermesi ve ifası / ifa edilmemesi karşısında nasıl değerlendirmeler yapılması gerekeceği, bu teknolojilerin kişisel verilerin korunmasına ilişkin düzenlemeler ile uyumu gibi hususlar ele alınacak ve ilgili bağlamda gündeme gelebilecek problemler derinlemesine irdelenecektir.

1) Knows the basic characteristics of blockchain and smart contracts, and is able to assess their legal qualifications.
2) Understands the current debates in the doctrine on blockchain and smart contracts, formulates and expresses their own views.
3) Follows judicial decisions on blockchain and smart contracts.
4) Follows the developments in comparative law regarding blockchain and smart contracts.

Teaching MethodsLecture, preparation of a seminar paper and presentation
Homework and ProjectsA seminar paper will be prepared as final examination (60%) and the paper prepared will be presented (40%). If assignments are not submitted on time and presentation obligations are not fulfilled without an excuse, the student will not be evaluated. In cases where a disciplinary investigation is required, the YÖK Student Disciplinary Regulations will be applied.
