Overall Educational Objective | Students will learn what “personal data” is and how it is protected as per both local and international regulations, understand the “right to privacy”, gain knowledge and problem-solving skills regarding the protection and processing of personal data, and understand the current problems in the field of data protection. | |||||
Course Description | Yaşadığımız çağda hızla gerçekleşen teknolojik gelişmeler ve bireylerin mahremiyet hakkına artan hassasiyetle birlikte, “Kişisel Veri” kavramı dikkate değer tartışmalara yol açmıştır. Verinin yönetimi bireyler, şirketler ve devletler için çok önemli bir konu haline gelmiştir. Bu doğrultuda veri korunma hukuku Türkiye dahil birçok devlet ve Avrupa Birliği de dahil olmak üzere uluslararası kuruluşlar tarafından düzenlemeye tabi olmuş ve hukukçuların gündeminde yer etmiştir. Söz konusu kurallar ve kurumlar bireylerin haklarının yanı sıra “veri sorumlusu” kişi ve kuruluşların yükümlülüklerini de düzenlemiştir. Bu yeni araçlar temel gizlilik hakkı ile verilerin ekonomik kullanımları ve değeri arasında hassas bir denge oluşmuştur; böylece yeni nesil hukukçuların bu alanda bilgi sahibi olması zaruri hale gelmiştir. Bu dersi tamamlayan öğrenciler, sadece verilerin korunması alanında pratik yetkinliğe sahip birer hukukçu olarak ayrılmayacak, aynı zamanda veri koruma hukukunun tarihsel ve teorik arka planını öğrenerek güncel ve gelecekteki gelişmeleri daha iyi anlayacaklardır. | |||||
Course Description in Turkish | In the age we are living in, the concept of "Personal Data" has been subject to considerable debate, due to rapid technological developments and the growing attention to the right of individuals to privacy. The management of data has become a very important topic, both for individuals, companies and governments. Accordingly, data protection law has become a hot topic, and subject to regulation by many countries including Turkey and international organizations including the European Union. These rules and institutions have regulated the rights of individuals, as well as obligations of “data controller” persons and entities. These new tools have created a delicate balance between the fundamental right of privacy and economic uses and value of data; thus it has become essential for the next generation of lawyers to have knowledge in this field. Students who have completed this course will not only be separated as lawyers with practical competence in the field of data protection but will also learn the historical and theoretical background of data protection law, allowing them to better understand current and future developments. |
Course Learning Outcomes and CompetencesUpon successful completion of the course, the learner is expected to be able to:1) Understand the definitions fundamental terms regarding data protection and privacy, 2) Understand the historical and theoretical context of the right to privacy 3) Gain deeper knowledge on national and international legislation on data protection and privacy, such as the Turkish Data Protection Law, the EC Directive 95/46/EC, and the EU General Data Protection Regulation among others, and the main differences between such legislation 4) Analyze liabilities of data controllers in Turkey, as well as data controllers established abroad who process data in Turkey 5) Understand practical issues in the field of data protection law and the role falling on attorneys to ensure protection of the rights of individuals and support compliance of data controllers with the law 6) Gather high-level of awareness about the functions and duties of privacy professionals |
