The main objective of this course is to examine the individual application mechanisms to international construction rights mechanisms and to analyze their different and similar aspects. |
Course Description |
The new international system established after the Second World War has led to the emergence of different actors and areas in international law. The Universal Declaration of Human Rights, which was adopted unanimously by the UN General Assembly on December 10, 1948, has been a universal milestone in the field of human rights. In the following period, more than 70 universal and regional human rights conventions were adopted and various human rights protection mechanisms were established. In this course, the powers of the UN Charter-based human rights mechanisms (such as Human Rights Council) and the mechanisms set out by the thematic human rights treaties (such as Human Rights Committee, CEDAW, Committee for the Prevention of Torture, Committee for the Rights of the Child) as well as the regional human rights mechanisms (such as the European Court of Human Rights) will be examined.

İkinci Dünya Savaşı’ndan sonra kurulan yeni uluslararası sistem, farklı aktörlerin ve alanların ortaya çıkmasına vesile olmuştur. 10 Aralık 1948 yılında İnsan Hakları Evrensel Beyannamesi’nin BM Genel Kurulu’nda oybirliği ile kabulü, insan hakları alanında evrensel bir milat teşkil etmiştir. Sonraki dönemde 70’ten fazla evrensel ve bölgesel insan hakları sözleşmesi yapılmış ve çeşitli insan hakları koruma mekanizmaları oluşturulmuştur. Bu derste, evrensel ve bölgesel düzeyde faaliyet gösteren ve bireylere şikâyet veya başvuru olanağı öngören Birleşmiş Milletler’in BM Antlaşması’na dayalı mekanizmalar (İnsan Hakları Konseyi gibi) ve tematik antlaşmalar çerçevesindeki mekanizmalar (İnsan Hakları Komitesi, CEDAW, İşkenceyi Önleme Komitesi, Çocuk Hakları Komitesi gibi) ile Avrupa İnsan Hakları Mahkemesi gibi bölgesel uluslararası örgütler nezdindeki mekanizmaların yetkileri irdelenecektir. |

2) The learner evaluates the impact of human rights mechanisms in the United Nations system in terms of human rights.
3) The student distinguishes the differences between the approaches of regional and universal mechanisms to human rights problems.
4) Student understands the role of individual application mechanisms in the development of human rights.
