Overall Educational Objective | The general educational objective of the course is to examine the international private law problems related to family law within the framework of doctrine, jurisprudence and current developments. | ||||
Course Description | Family law issues with foreign elements, applicable law, recognition and enforcement of court decisions in this field will be discussed within the scope of relevant legislation and international conventions. | ||||
Course Description in Turkish | Yabancı unsur içeren aile hukuku konuları, uygulanacak hukuk, bu alanda verilmiş mahkeme kararlarının tanınması ve tenfizi hususları ilgili mevzuat ve milletlerarası sözleşmeler kapsamında tartışılacaktır. |
Course Learning Outcomes and CompetencesUpon successful completion of the course, the learner is expected to be able to:1) To qualify the disputes within the scope of international family law. 2) To determine the country law applicable to international family law disputes 3) To be able to discuss other principles of private international law such as public order and directly applicable rules according to the law applicable to international family law disputes 4) To comprehend the principles regarding the recognition and enforcement of foreign court decisions on international family law in Turkish courts and the international jurisdiction issue |
