Overall Educational Objective The aim of the course is to provide students with in-depth knowledge about the historical development of administrative procedure law, its unique aspects and current debates in this field.
Course Description Derste idari yargılama hukukunun genel yapısı ve kurumları incelendikten sonra, idari yargılama hukuku kural ve kurumları Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi tarafından adil yargılanma hakkına ilişkin geliştirilmiş kriterler ve verilmiş kararlar ışığında değerlendirilecektir. 198 Anayasasında, Anayasa Mahkemesine bireysel başvuru hakkı düzenlendikten sonra idari yargı yerlerinin kararları ve uygulamaları insan hakları perspektifinden yoğun bir biçimde değerlendirilmeye başlanmıştır. Bu kapsamda en öne çıkan başlıklardan birisi de idari yargılama hukukunun adil yargılanma hakkı temelinde değerlendirilmesi olmuştur. Gerçekten de Anayasa Mahkemesi, gerek idari yargılama usulü kanununun çeşitli hükümlerinin, gerek idari yargı yerlerinin bazı yerleşik uygulamalarının adil yargılama hakkını ihlal ettiğini tespit eden kararlar vermiştir. Günümüzde idare hukukunda olduğu gibi idari yargılama hukukunda da kurum ve kavramların insan hakları temelli ele alınması ve bu hukuk alanının insan haklarını güvence altına alacak şekilde dönüşmesi ve gelişmesi üzerine eleştirel bir perspektifle düşünmek önem kazanmıştır. Bu derste bu perspektif adil yargılanma hakkı ve idari yargılama hukuku başlığı altında ele alınmaya çalışılacaktır. Öncelikle idari yargılama hukukunun genel yapısı, gelişimi ve kurumları incelendikten sonra ulusal ve uluslararası hukukta adil yargılanma hakkının ele alınışına dair genel bir çerçeve çizilecektir. Daha sonra adil yargılanma hakkının gerekleri idari yargılama hukuku özelinde ayrı başlıklar olarak ele alınacaktır.
Course Description in Turkish After examining the general structure and institutions of the administrative jurisdiction law, the rules and institutions of this area of law will be evaluated in the light of the criteria and decisions of the Constitutional Court and the European Court of Human Rights on the right to a fair trial. After the Constitution regulated the right of individual application to the Constitutional Court, the decisions and practices of administrative jurisdictions began to be intensively evaluated from a human rights perspective. In this context, one of the most prominent topics has been the evaluation of administrative jurisdiction law on the basis of the right to a fair trial. Indeed, the Constitutional Court has ruled that various provisions of the administrative jurisdition law and some established practices of administrative courts violate the right to a fair trial. Nowadays, it has become important to think critically about the transformation and development of this field of law in a way to guarantee human rights and to consider the institutions and concepts in administrative law as well as in administrative jurisdiction law on the basis of human rights. In this course, this perspective will be discussed under the title of the right to a fair trial. First of all, the general structure, development and institutions of the administrative jurisdiction law will be examined and then a general framework will be drawn on the treatment of the right to a fair trial in national and international law. Then, the requirements of the right to a fair trial will be discussed as separate headings in the administrative jurisdiction law.

Upon successful completion of the course, the learner is expected to be able to:
1) Have an in-depth knowledge of the law of administrative proceedings
2) Comment on the current debates on the law of administrative jurisdiction
3) Adil yargılanma hakkının gereklerini açıklar
4) Evaluates the provisions of administrative procedure and established case law of administrative jurisdictions in terms of the right to a fair trial
5) Analyzes the decisions of the Constitutional Analyzes the prominent decisions of the Constitutional Court and the European Court of Human Rights, which are related to the right to a fair trial and affect the law of administrative proceedings.
