Overall Educational Objective In terms of administrative law and property law, zoning and construction issues, which constitute a crossroads area in terms of zoning and construction law, in the light of both public law zoning rules and provisions related to private property, zoning and construction practices are processed separately in terms of each stage. In this context, on the one hand, the stages of the zoning order from the cadastre to be handled, and the types of contracts, building licences and building inspection processes that will be encountered in the construction process after the completion of the zoning applications. Thus, zoning applications and construction processes of non-zoned areas, including obtaining a certificate of occupancy (occupancy licence) and, if necessary, the transition to condominium ownership.
Course Description Zoning and planning (Strategic land plans, regional plans, regulatory zoning plans, practical zoning plans, creating the parcels; zoning and construction programs of the local authority, hierarchy of plans, zoning regulation participating share, publicization participating share, social fields, certificates of construction (construction certificate, basement certificate, habitation certificate), conversion of the land ownership into flat ownership. Construction contracts, Construction contract in return for land share and its application, FIDIC contracts.
Course Description in Turkish İmar planları (Stratejik ülke planları, bölgesel planlar, nazım imar planları, uygulama imar planları, parselasyon uygulaması; planlar hiyerarşisi, düzenleme ortaklık payı (DOP), kamulaştırma ortaklık payı (KOP), İdarenin imar programları, sosyal donatı alanları, yapı ruhsatları (inşaat ruhsatı, temel üstü ruhsatı, yapı kullanma izin belgesi), kat mülkiyetine geçiş. Eser sözleşmesinin bir türü olarak inşaat sözleşmeleri, arsa payı karşılığı inşaat sözleşmesi ve uygulaması, FIDIC sözleşmeleri

Course Learning Outcomes and Competences

Upon successful completion of the course, the learner is expected to be able to:
1) Mastering the process of transformation of cadastral islands and parcels formed by cadastral cadastre into zoning islands and parcels as a result of possible zoning application,
2) To be able to start and maintain the construction, to obtain the necessary occupancy permit after the completion of the construction and, if necessary, to master the processes of transition to condominium ownership,
3) To have knowledge of FIDIC contracts and related contract form books that can be applied to large infrastructure constructions such as dams, roads, railways, metros,
4) Understand the types of construction contracts and in particular the principles of the land share construction contract.
