| Course Description | The course, through the analysis of sources of Italian law, will give students a basic knowledge of Italian law system. On the basis of the course, the first 12 articles of the Italian Constitution (fundamental principles) are analysed with reference to the most relevant legal arrangements of Italian civil law, Italian public and criminal law. The course follows Orestano´s theory of “esperienza giuridica” and analyses the Italian law system by sources, data, case law, and legal doctrine. The methodology used is the research of fundamental principles in Italian statements with the main purpose to discover the “ratio legis” in each statement. Special consideration is dedicated to the legal English terminology used in the course and to sponsor students to think in a comparative juridical way, finding common roots between Italian and Turkish rules. | |||||||
| Course Description in Turkish | Bu ders, İtalyan hukukuna ilişkin kaynakları analiz ederek, İtalyan hukuk sistemi ile ilgili temel bir bilgi vermeyi hedeflemektedir. Derste, İtalya Anayasası’nın temel hak ve özgürlüklere ilişkin ilk 12 maddesi, İtalyan medeni kamu ve ceza hukukuna ilişkin ilgili düzenlemeler ele alınmaktadır. Derste Oresanto’nun “esperienza giuridica” adlı teorisi takip edilmekte ve İtalyan hukuk sistemi, kaynaklar, veriler, mahkeme kararları ve doktrin ışığında incelenmektedir. Yasal düzenlemelerin arkasındaki amacın tespit edilmesi hedeflenmektedir. Derste kullanılan İngilizce terminolojiye de özel önem verilmekte ve öğrenciler karşılaştırmalı hukuku da düşünerek İtalyan ve Türk hukuk kurallarının ortak kökenlerini bulmaya teşvik edilmektedir. |
