Overall Educational Objective To learn the legal framework of trademark law and related judicial decisions
Course Description The concept and types of trademark and registrability criteria will be examined in light of court decisions. Conditions of trademark infringement and remedies will be studied.
Course Description in Turkish Derste özellikle Yargıtay kararları ışığında, marka kavramının tanımı, türleri, tescil edilebilirlik şartları incelenecektir; hakka tecavüz teşkil eden hallerin neler olduğu tespit edilecektir; haklara tecavüz durumunda ileri sürülebilecek hukuki talepler incelenecektir.

Course Learning Outcomes and Competences

Upon successful completion of the course, the learner is expected to be able to:
1) Knows the purpose of trade mark law.
2) Knows the definition and types of the concept of trademark.
3) Knows the conditions of registration of trademark right, registration procedure and protection period.
4) Knows the conditions under which it is possible to grant a licence on the trademark right and the types of licences.
5) Knows and discusses the termination of the trademark right.
6) Counts and discusses the acts that constitute infringement of the trademark right.
7) Knows the legal proceedings related to the trademark right and the conditions of form.
8) Knows and discusses the claims that the person whose trademark and patent right is infringed can claim.
