Overall Educational Objective The goal of this course is to teach human rights master's program students how to use human rights texts and tools from a gender perspective. ability to analyze from a legal perspective and to handle and apply human rights norms with gender sensitivity as a legal practitioner is to gain the ability.
Course Description The course ‘gender and human rights’ aims to critically assess the evolution of the international human rights regime from a gendered perspective. Fort his purpose, first it will discuss the implications of the public/private divide for the international human rights law and will study the gendered categories of ‘right’, ‘damage’ and ‘violation’. The course will further explore the transformative interventions of the second wave feminism and feminist legal movement which resulted in important legal accomplishments for women’ rights. The course will also examine legal progress accomplished at the national level for gender equality, by drawing specifically on the case law of the Constitutional Court.
Course Description in Turkish Toplumsal cinsiyet ve insan hakları dersi uluslararası insan hakları hukukunun gelişimini toplumsal cinsiyet perspektifinden eleştirel bir bakış açısıyla analiz etmeyi amaçlar. Bunun için ilk olarak kamusal/özel ayrımının uluslararası insan hakları rejiminin işleyişinde yarattığı dışlama biçimleri ele alınacak; ihlal, zarar ve hak kategorilerinin cinsiyetlendirilmiş tanımlarına bakılacaktır. Sonrasında ise, özellikle ikinci dalga feminizmin ve feminist hukuk hareketinin etkisiyle uluslararası insan hakları rejimini dönüştürmek için yapılan müdahaleler ve elde edilen hukuki kazanımlar incelenecektir. Ders kapsamında ayrıca ulusal hukukta, bilhassa Anayasa Mahkemesi önüne gelen bireysel başvurularda toplumsal cinsiyet eşitliği adına elde edilen kazanımlar da ele alınacaktır.

Upon successful completion of the course, the learner is expected to be able to:
1) Learn the public/private distinction that shapes the field of law in liberal political theory
2) To comprehend the decisive impact of the public/private distinction on the development of international human rights through exemplary texts and mechanisms
3) To see the gender-exclusive language, structure and functioning of the first modern human rights law texts and mechanisms
4) To comprehend the gains achieved in the name of gender equality through legal interventions against the exclusionary structure of the human rights regime and the rights claims that have gained normative recognition
5) To gain the ability to effectively apply norms in practice about Human rights that secure gender equality through assignments and presentations that will be prepared in the field of gender and human rights.
