Overall Educational Objective To teach the legal interest protected by crimes against public trust and the types of crimes related to this subject.
Course Description Public trust is a general, social, and permanent right and value, which is shaped by recognizing the protection of the things that the legal order awards ability to prove a legal incident and of forms and symbols whose trueness and authenticity are trusted. The concept is briefly "individual’s right not to be deceived in the society." Crimes against the public trust are broadly crimes of forgery. Crimes against the public trust are (1) forgery (counterfeiting) on ​​public values, (2) forgery of seals, (3) forgery of documents; Forgery (counterfeiting) on ​​public values ​​is also divided into three sections: (a) forgery of money, (b) forgery of public value papers (with values ​​equivalent of money), (c) forgery of valuable stamps. These crimes will be examined separately and the issues will be discussed in the light of the relevant judicial decisions.
Course Description in Turkish Kamunun güveni; hukuk düzeninin, herhangi bir hukuksal olayı kanıtlama yeteneği tanıdığı şeylerle, doğruluk ve gerçekliğine herkesçe güvenilmesini öngördüğü şekil ve alametlerin sahtecilikten korunmalarını görmek ve bilmek biçiminde oluşmuş genel, toplumsal, sürekli bir hak ve yarardır. Kavram kısaca “Bireyin, toplumda aldatılmamak hakkıdır.” biçiminde de tanımlanabilir. Kamunun güvenine karşı suçlar geniş anlamda sahtecilik suçlarıdır. Kamunun güvenine karşı suçlar; (1) kamusal değerler üzerinde sahtecilik (kalpazanlık), (2) mühürlerde sahtecilik, (3) belgelerde sahtecilik olarak üç ana kısma; kamusal değerler üzerinde sahtecilik (kalpazanlık) da kendi içinde (a) paralarda sahtecilik, (b) kamu değeri kağıtlarında (paraya eşit sayılan değerlerde) sahtecilik, (c) değerli damgalarda sahtecilik biçiminde üç bölüme ayrılmaktadır. Bu suçlar ayrı ayrı incelenecek, ilgili yargı kararları ışığında konular tartışılacaktır.
