Overall Educational Objective To teach the rights of the suspect and the defendant in the criminal proceedings.
Course Description Course subjects are the right to a fair trial, the right to a public trial in a court that conforms to the independent-impartial-ordinary judge principle, the right to seek justice (to apply to the court), the right to be tried within a reasonable time, the right to defense, the right to benefit from the presumption of innocence, the right to benefit from the principle of legality in crime and punishment, the right not to be subject to torture and degrading punishments and treatments, the right to seek legal remedies and reasoned decisions, and finally, the rights related to personal security. Decisions of the Turkish Constitutional Court and the European Court of Human Rights on this issue will also be evaluated.
Course Description in Turkish Ders kapsamında adil yargılanma hakkı, bağımsız-tarafsız-olağan hâkim ilkesine uygun bir mahkemede aleni yargılanma hakkı, hak arama (mahkemeye başvurma) hakkı, makul sürede yargılanma hakkı, savunma hakkı, masumluk karinesinden yararlanma-lekelenmeme hakkı, suçta ve cezada kanunilik ilkesinden yararlanma hakkı, işkence ve onur kırıcı ceza ve muamelelere tabi olmama hakkı, yasa yollarına başvurma ve gerekçeli karar hakkı ve son olarak kişi güvenliği ile ilgili haklar incelenecektir. Bu konudaki Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi kararları da değerlendirilecektir.

1) To internalise the scope of the right to a fair trial
2) to raise awareness of the judgements of the European Court of Human Rights on the protection of the rights of suspects and accused persons
3) To learn and internalise the rights of the suspect and the defendant in the investigation and prosecution phases of criminal proceedings
