Overall Educational Objective To teach the way of appeal, which is the last degree review in criminal proceedings
Course Description The concept and nature of criminal appeal, those who have the right to appeal, conditions to file an appeal case, appeal trial at the Turkish Court of Cassation, actions taken and decisions that can be rendered by the Court of Cassation during the appeal review, status of the first instance court and the Regional Court of Appeals after the decision by the Court of Cassation will be examined in this course.
Course Description in Turkish Temyiz kavramı ve niteliği, temyiz yoluna başvurma hakkı bulunanlar, temyiz davası açma koşulları, Yargıtay’da temyiz yargılamasının yapılması, Yargıtay tarafından temyiz incelemesi sırasında yapılan işlemler ve verilebilecek kararlar, Yargıtay’ın kararından sonra ilk derece ve Bölge Adliye Mahkemesinin durumu incelenecektir.

Course Learning Outcomes and Competences

Upon successful completion of the course, the learner is expected to be able to:
1) To teach the legal remedy of appeal against the final judgements/decisions of the courts of first instance and regional courts of appeal
2) to raise awareness of how the judge of the Court of Cassation, as the judge of the judgement, supervises/reviewed the reasoning of the judgement
3) Explain how the Court of Cassation fulfils its duties of ensuring discipline in reasoning and training first instance/regional court of appeal judges through its reasoned review
