Overall Educational Objective With this course, it is aimed to instruct students to learn the procedural rules of the individual application mechanism to the Constitutional Court and the European Court of Human Rights comparatively.
Course Description In this course, procedural aspects of the individual application to Constitutional Court and European Court of Human Rights are discussed comparatively. In this context, the following topics will be discussed: principles of subsidiary, Court’s jurisdiction regarding ratione personae, ratione loci, raitone matarae and ratione temporis, exhaustion of domestic remedies and its exceptions and time limit (30 days/four months rule), other admissibility criterion, pilot judgments, consequences of a judgement finding violation, enforcement of the judgments.
Course Description in Turkish Bu ders kapsamında, İnsan Hakları Avrupa Sözleşmesi ve Anayasa Mahkemesine Bireysel Başvuru sisteminin usul yönü karşılaştırmalı olarak ele alınmaktadır. Bu çerçevede, ele alınacak başlıklardan bazıları şunlardır: İkincillik ilkesi, Mahkemelerin kişi, konu, yer ve zaman bakımından yetkileri, iç hukuk yollarının tüketilmesi ve istisnaları, başvuru süresi (30 gün/4 ay), diğer kabul edilebilirlik koşulları, pilot kararlar, ihlal kararlarının sonuçları, kararların uygulanması
