Overall Educational Objective Understanding which dispute resolution methods are available for disputes involving a foreign element and how special situations related to disputes should be resolved
Course Description Resolution of a dispute containing foreign element by using certain conciliation or judicial procedures after the dispute arises. The scope of the course includes: Dispute resolution before national courts and arbitration courts or dispute resolution through direct negotiation methods, mediation and mediators, technical expert panel, pre-arbitration procedure, intervention of neutral third parties, diplomatic protection and alternative dispute resolution techniques.
Course Description in Turkish Yabancılık unsur içeren uyuşmazlık ortaya çıktıktan sonra belirli uzlaştırma veya yargı usullerinin kullanılması ile çözümlenmesi. Dersin kapsamında: Milli mahkemeler, hakem mahkemeleri, doğrudan müzakere yöntemleri, uzlaştırma ve arabulucu heyetleri, teknik bilirkişilik heyeti, ön hakemlik usulü, tarafsız üçüncü kişilerin uyuşmazlığa müdahalesi usulleri, diplomatik yol ve alternatif uyuşmazlık çözme teknikleri yer almaktadır.
