Overall Educational Objective In the course, general approaches and problems regarding the Theory of Law will be discussed.
Course Description This course aims to seek an answer to the question “what is law” through an analysis of scientific works of theoreticians studying the theory of law. In this framework various theoretical methodologies will be examined, and differences between method in law and methodology of law, between natural law school and legal positivism, between voluntarist approach and non-voluntarist approach, between the approach that limits law in a historical framework and the approach that identifies law with social formation will be clarified.
Course Description in Turkish Derste, “Hukuk Nedir?” sorusunun cevabı Temel Hukuk Kuramı eserleri ve yazarları gözden geçirilerek aranacaktır. Bu yolda farklı kuramsal yöntemler ele alınacak, Hukukta yöntemle/Hukuki Yöntembilim, Doğal Hukukçu yaklaşımla/Pozitivist yaklaşım, İradeci yaklaşımla/İradeci olmayan yaklaşım, Hukuku tarih içinde sınırlayan yaklaşımla/Hukukiliği sosyallikle özdeşleştiren yaklaşım, Felsefi yaklaşımla/Antropolojik yaklaşım, Hukukla/Hukuki Bilim ve Hukuklarla/Hukukilik arasındaki farklar ortaya koyulacaktır.

Course Learning Outcomes and Competences

Upon successful completion of the course, the learner is expected to be able to:
1) To learn that the theoretical background of law is an indispensable prerequisite for defining law.
2) Thus, it is necessary to understand that it is necessary to focus on theory in solving various legal problems and in legal education.
3) To prevent the definition of law from being frequently identified with a narrow Legalism.
4) To understand the basic difference between Legal Science and Philosophy of Law.
5) A Legal Science that identifies legality with sociality, with its essential elements, asks "What is Law?" To find out how you answered the question.
